Overview

In simple terms, the contractor’s responsibility is to build to the designer’s specification, but contractors and sub-contractors can end up taking responsibility for some or all of the design in a number of different ways.  If the contract or design documents are not explicit then establishing liability for defects can become complicated, and costly.

This seminar will examine the following aspects:

  • Design and Build Contracts
  • 'Reasonable skill and care’ or absolute obligations
  • Fitness for Purpose
  • Professional Indemnity Insurance Cover
  • A recent case – MT Højgaard A/S v E.ON Climate and Renewables UK
