Extensions of time & construction schedule analysis: two year update

The seminar focuses on developments in the field of delay analysis over the last two years. The subject matter is wide-ranging and covers contract terms relevant to extensions of time, concurrent delay, the latest Society of Construction Law delay and disruption protocol, and retrospective v prospective analyses.

Tue 18 Sep 2018
06:30 PM - 08:00 PM
Crowne Plaza Yas Island, Abu Dhabi, UAE
1.5 hours formal CPD

The seminar commences by providing an overview of the 2nd SCL delay and disruption protocol issued in 2017 and the updated advice provided therein, putting it in context against the earlier SCL protocol of 2002.

The seminar thereafter provides commentary on case law where hotly debated issues were dealt with, and addresses current topics including: doing away with standard practice through incorporation of specific contract terms, whether to adopt a retrospective or prospective delay analysis approach, and the competing views on concurrent delay.

Learning outcomes

Upon completion, the attendees will:

  • Develop an understating of the latest commentary and advice provided in the SCL protocol;
  • Examine how the courts interpreted certain extension of time clauses;
  • Recognise the main, and opposing, schools of thought on matters of concurrent delay; and
  • Appreciate the arguments for and against prospective and retrospective approaches to analysing delay.
