Dubai CPD on Valuation of Variations under FIDIC 1999

FIDIC 1999 Red Book does not have adequate provisions to value some Variations and also to value some original scope of work. This CPD educates the practitioner on such shortcomings.

Unlike in the earlier Standard Forms of FIDIC contracts which had comprehensive provisions to value variations, FIDIC 1999 Red Book introduced very complex new provisions to value both the original scope of work and the Variations under a single Clause, resulting in confusions about its correct application. Though one shortcoming has since been addressed through the 2017 Second Edition, most of the confusions and shortcomings still exist.

During this CPD the shortcomings found in these valuation provisions will be discussed and also the most appropriate application of these provisions using worked examples will be looked at.

Learning outcomes

Attendees will gain a better understanding of these confusing provisions in FIDIC 1999 and;

  • How to avoid any disputes resulting from the shortcomings, by amending these provisions during the tender stage.
  • (If required), valid arguments for a preference to adopt the valuation provisions in earlier FIDIC versions.
  • Material for research in further improvements of similar provisions.

Meet the speaker

Professor Indrawansa Samaratunga has been in the region for 43 years and has been a mentor to hundreds of young members. In March this year, Prof. Sam completed his 35th year as a Fellow of the Institution. His career in Quantity Surveying, Contract Administration and Dispute Resolution spans over 52 years with Developers, Consultants and Contractors in Sri Lanka and Middle East. Over five thousand practitioners have passed through his trilogy of short intensive course training programmes "Sound Contract Administration".

Prof. Sam is a regular speaker at CPD events sharing his knowledge and experience with the industry professionals. Many construction and related industry stakeholders consult him for specialist advice when faced with complex issues in Contract Formation, Contract Administration and Dispute Resolution.
